General Terms and Conditions

These General Terms and Conditions apply to all services provided by Details by Jessica Oy. They cover, but are not limited to, photography, video, media productions, website and brand design, the transfer of usage rights, and the sale of any other services offered by Details by Jessica Oy.

All information and services sold on the Details by Jessica Oy website are available, and these Terms and Conditions apply, within Finland. Services are provided in English, Finnish and Swedish.

Definitions

• Service means any service provided by Details by Jessica Oy, including but not limited to photography, video, media production or any other service individually or in combination.

• Agreement means a written agreement between the Supplier and the Customer, or an offer prepared by the Supplier and accepted by the Customer, or a service purchased from our online store.

• Customer means a company, entity or person purchasing a licence, intellectual property right or other service provided by the Supplier.

• Supplier means Details by Jessica Oy.

• End Product means the photographs, video, media files or other intellectual property created by the Supplier and delivered to the Customer.

• Production means the Supplier’s activities to perform, produce and deliver the Service and End Product as ordered by the Customer.

Obligations of the Supplier

The Supplier undertakes to produce Services and End Products with the quality, planning and care expected of a professional provider. We are responsible for carrying out Production according to the agreed plan, for correcting technical errors at no additional cost, and for informing the Customer without delay of any delays, changes or issues.

Obligations of the Customer

The Customer agrees to provide all necessary information, files and/or materials within agreed deadlines to enable successful Production. The Customer is responsible for ensuring that it has the intellectual property and other rights to any materials provided. If such materials are not supplied, the Supplier may obtain them on behalf of the Customer and invoice any additional costs. Delays in providing materials may lead to delayed Production and delivery. The Customer must inform the Supplier immediately of any changes, delays or obstacles.

End Products

The Supplier’s previous work can be viewed on the Details by Jessica Oy website and social media. While we do not guarantee that new End Products will be identical to previous outputs, they will meet comparable quality standards. The Supplier retains the right to decide on the visual and aesthetic style of End Products.

All End Products are professionally edited (exposure, white balance, contrast and cropping). Extensive or additional editing is charged separately. The Supplier decides which End Products are delivered. The Customer does not have a right to all material if the Supplier deems it technically or aesthetically unsuitable.

Photographs are delivered via a secure digital Pixieset gallery. Delivery of other products will be agreed separately. The Supplier backs up End Products for 6 months after assignment; there is no obligation to store them thereafter.

Delivery & Acceptance

If the Customer does not raise written complaints within 14 days of delivery, or if the End Products have been accepted for publication (e.g. on a website or social media), the order shall be deemed accepted, whichever occurs first.

Changes to End Products

Modifications included in the agreed plan are made at no additional charge. Any unplanned changes requested by the Customer are invoiced separately at the current price list after approval. Only the Supplier may modify End Products unless otherwise stated in the Agreement.

Pricing & Payment Terms

Purchases through the online store require the Customer to be at least 18 years old and provide valid payment information. We reserve the right to cancel an order if payment cannot be processed.

For customised Services, the Supplier may charge a reasonable booking fee (deducted from the final invoice). Booking fees are non-refundable if the Customer cancels or changes Production less than 14 days before the agreed date. The Supplier may issue interim invoices as Production progresses. All invoiced Services are payable within 14 days unless otherwise agreed. Prices in offers and contracts are VAT-exclusive; VAT is added as applicable. Online store prices include VAT.

Usage and publication rights to End Products begin when the Supplier has received full payment unless otherwise agreed. Travel, accommodation and daily allowances are invoiced separately as agreed.

Permissions & Rights

Ownership and intellectual property rights of material created during Production remain with the Supplier. The Customer receives usage rights to End Products as agreed. The Customer may use End Products in its activities but may not sell, transfer or sub-licence them to third parties without the Supplier’s written consent.

Delays, Cancellations & Force Majeure

If Production is significantly delayed or cancelled by the Supplier, the Customer may request a refund of the booking fee (not exceeding the contract value). If the Customer suspends Production for reasons beyond the Supplier’s control, the Supplier may invoice for work performed and costs incurred. In cases of Force Majeure beyond our control, Production may be suspended without liability. Both parties must inform each other promptly and agree on changes. If Production is completely suspended, the Supplier may invoice for work performed and costs incurred.

Liability

The Supplier is liable for direct property damage or personal injury caused by negligence but not for indirect or consequential damages (such as lost profit), unless caused intentionally or by gross negligence. Liability is limited to the full price of the Services.

Confidentiality

Both parties undertake to keep confidential all information received from the other party that is marked as confidential or reasonably understood as such. Confidential information may not be used for non-contractual purposes. The Supplier has the right to use and publish End Products and materials created during Production as references unless otherwise agreed.

Agreement Formation

The Production Agreement is deemed concluded when the Customer accepts an offer in writing or by email, or upon online payment. Starting Production based on verbal or other acceptance also constitutes an agreement. Changes to plans or Production must be agreed in writing or by email.

Governing Law

These Terms and Conditions are governed by the laws of Finland. Details by Jessica Oy reserves the right to amend these Terms from time to time. The current version is always available on our website.
